WhiskThe short version: your AI agent can prepare a workspace, but only you can make it real. You accept these terms yourself when you claim your team (or hand its confirmation code to your agent). Until then nothing is binding and the workspace deletes itself after 7 days. Your data is yours. We charge in advance, cap our liability at what you've paid us recently, and ask you not to break the law or the service.
These terms are a binding agreement between you (and, where you act for one, your organisation) and Whisk, covering the Whisk platform and everything served under whisk.run and whisk.page. An AI agent acting on your behalf can prepare a provisional workspace but cannot accept these terms for you. You accept them by claiming your team — confirming with the code emailed to you, whether entered on Whisk or relayed through your agent — or by signing in to and using an existing team. We record the version you accepted, when, and from where. Provisional workspaces that are never claimed are deleted automatically after 7 days, and no agreement is formed.
A team on Whisk is identified by an email domain: everyone with an address at that domain belongs to the same team. The first person to claim the team owns it; others join as members. Ownership can be transferred, including by proving control of the domain via DNS. A personal mailbox forms a one-person team. You must give us accurate information and keep control of your email account — anyone who controls your email can act as you on Whisk.
You must be at least 16 years old. If you accept for a company or other organisation, you confirm you're authorised to bind it, and "you" in these terms includes it.
Everything your team builds and stores on Whisk — code, app data, files — belongs to you. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, process, back up, and transmit it, solely as needed to run the service. You can export your code and data, and you can delete your team (and everything in it) at any time. You are responsible for your content, for the apps your team publishes, and for having the rights to whatever you put on the platform.
Don't use Whisk to break the law, infringe others' rights, distribute malware, phish, spam, mine cryptocurrency, or probe or disrupt infrastructure (ours or anyone's). Don't attempt to breach another team's data or exceed your own access. Don't put secrets in app code that ships to browsers. Usage is subject to fair-use limits and the quotas of your plan; we may throttle or suspend workloads that endanger the platform or other teams.
Whisk — the platform, its software, design, templates, and documentation — is ours and remains ours. We grant you a limited, non-exclusive, non-transferable right to use it while these terms are in force. You may not copy, resell, sublicense, or reverse-engineer the platform, build a competing service from it, or scrape or systematically extract it, except where the law expressly permits. Starter templates are licensed to you for building your team's apps — what you build with them is yours.
We store what the service needs: account and team details, your code and app data, billing records, and operational logs (including a redacted record of agent API activity, kept to run and improve the service and to help you debug). We don't sell personal information. We use subprocessors to run Whisk — currently InstantDB (database and authentication, US), Stripe (payments — we never see card numbers), and Postmark (email delivery). Paid plans are billed in advance on a monthly subscription through Stripe. Upgrades take effect immediately, with the prorated difference charged at once; downgrades and cancellation take effect at the end of the paid period (credit from mid-cycle downgrades applies to future invoices — no cash refunds). If a renewal charge fails we retry; if payment isn't resolved, the team drops to the Free plan when the subscription ends. Existing work isn't deleted for going over a smaller plan's limits, but new creation is blocked until usage fits the plan. Prices may change with at least 30 days' notice, applying from your next billing period. Fees exclude any applicable taxes.
You can stop using Whisk, downgrade, or delete your team at any time. We may suspend or terminate a team that materially breaches these terms, creates legal exposure, endangers the platform, or doesn't pay — where practical we'll warn you first. Unclaimed provisional workspaces are deleted after 7 days. When a team is deleted, its apps, repositories, and data are deleted with it.
Whisk is provided "as is" and "as available", without warranties of any kind, express or implied. It may change, have downtime, or lose data — keep your own backups of anything you can't afford to lose. To the maximum extent the law allows: we're not liable for indirect, incidental, or consequential loss (including lost profits, revenue, or data), and our total liability for all claims under these terms is capped at the fees you paid us in the 3 months before the event giving rise to the claim. Nothing in these terms excludes liability that cannot lawfully be excluded; if you use Whisk for business purposes, the New Zealand Consumer Guarantees Act 1993 does not apply.
If a third party brings a claim against us arising from your content, your apps, or your breach of these terms, you'll defend us against it and cover the resulting costs and damages.
We may update these terms. For material changes we'll give reasonable notice (email to team owners and/or a notice on the platform). Continuing to use Whisk after a change takes effect means you accept the updated terms; if you don't, stop using the service and delete your team.
These terms are governed by the laws of New Zealand, and the New Zealand courts have exclusive jurisdiction over any dispute that can't be resolved between us directly.
